Agreement to Website Terms and Conditions & Use in Compliance with Laws

These Terms and Conditions ("Terms and Conditions") apply to the website owned and operated by EZ Online Sales, Inc. located at www.shoponline.ezpawn.com (this “Website”).  EZ Online Sales, Inc. and its affiliates, EZCORP, Inc. and the operating subsidiaries thereof, are referred to as “we.”  By acting, using or transacting on this Website, you agree to these Terms and Conditions.  You agree to that you have read and understand these Terms and Conditions and that your use of the Website will be strictly in compliance with these Terms and Conditions and all applicable laws.  You also agree that we have the right to change these Terms and Conditions at any time, without notice to you.  Except as stated herein, these Terms and Conditions constitute the entire agreement among us and you related to this Website.

 

Pre-Owned Merchandise for Pick Up at Retail Locations

This Website makes available secondhand goods for purchase online and pick up by you at our retail locations.  The goods are owned by us or our affiliates, the operating subsidiaries of EZCORP, Inc.  EZ Online Sales, Inc. is selling the item online on behalf of its affiliate, which owns and operates the applicable retail location. 

 

The secondhand goods advertised on this site are not available for delivery.  You must pick up the items at the retail location listed with the advertised item.  In order to pick up purchased items, you must present a copy of your Purchase Confirmation email and a photo ID.  Pricing or availability errors may occur and we reserve the right to cancel any purchase.  The information listed and the availability of any items is subject to change without notice.  Purchase of items will be canceled if not picked up within certain lime limits as further described in these Terms and Conditions under Cancellation Policy.  Return of items purchased is conditioned upon our Return Policy described in these Terms and Conditions.

You expressly acknowledge that such goods are pre-owned goods that were obtained by us by purchase from consumers or as collateral for defaulted pawn loans made in the ordinary course our business by our retail pawn and/or buy/sell locations.  While we endeavor to accurately describe and make available all items listed for sale, we make no representations as to the completeness, accuracy, reliability, validity, or timeliness of such listings, descriptions, or images (including any features, specifications, and prices).  Furthermore, we cannot guarantee that your monitor's display of any color or image will accurately reflect actual item. The description of the item is subjective and all attributes, including weights, size, measure, color, and condition are approximate and are for convenience only.  References to product names, marks or brands is for informational purposes only and do not constitute an endorsement.

 

We endeavor to remove all added content and images from electronic media; however, we are not liability to you for content in or on any item you purchase.  We are not responsible for and cannot guarantee the performance of any good purchased. 

 

Use of Representative Photos and General Descriptions of Condition

We display representative photos of new merchandise in order for you to identify the item you are buying.  However, this photo is not a photo of the actual object you are buying.  We sell pre-owned merchandise in used condition.  The items we generally display evidence of prior use.  We provide a general description of the condition of pre-owned merchandise.  However, these descriptions do not depict the exact condition of the merchandise.  For this reason, we allow cancellation of your purchase up until the time you pick up the product from the store.  After inspecting the actual item in our store, you may cancel your purchase prior to leaving the store with the item.  Refer to our Cancellation Policy and Return Policy and these Terms and Conditions for additional details. 

 

Purchases

You represent and warrant that you have the right to use any credit card, debit card or other means of payment that you provide to us on this Website. By providing payment card information to us, you authorize us to store and use the card as a payment method for purchases made by you or through an account created by you. We reserve the right to refuse or cancel a purchase transaction for any reason.

 

Value your Item

We offer online appraisals of merchandise for your consideration in selling the merchandise to us or using it to obtain a pawn loan at one of our retail locations. These appraisals are for informational purposes only.  They also are subject to your accurate description of the merchandise.  While we endeavor to be accurate in our assessed value, we may change an appraised value at any time for any reason at our sole discretion.  We also may decline to engage in a purchase or pawn loan on an item for any reason at our sole discretion.

 

Cancellation Policy

Prior to picking up your item at our store, you may cancel your puchase by email at customerservice@ezpawn.com or by cancelling your purchase in person at the store.  If you do not pick up your item at our store within 7 days of purchase, your purchase will be canceled.  If for any unforseen reason you item becomes unavailable between the time of your online purchase and the time you pick up the item, your purchase will be canceled.   In the event of cancellation of your purchase for any reason, whether initiated by you or us, in accordance with the terms of this Cancellation Policy, the purchase price will be refunded to the payment mechanism used in the purchase transaction.  No cash refunds.

 

Return Policy

If you return an item to our store within 1 day of pick up and the item is in the same condition as it was at the time of pick up, with all accessories, the purchase price will be refunded to the payment mechanism used in the purchase transaction.  No cash refunds.

 

After the 1 day period referenced above, within 6 months after the date of online purchase, you may either: (1) exchange the item for similar merchandise of equal value, as determined by us, if available; or (2) return the item in exchange for store credit of equal value, as determined by us.  In order to be returned or exchanged, an item must be in the same condition in which it was picked up, a copy of the “Purchase confirmation” email must be presented, and all accessories present at the time of purchase must accompany the return.

We make no representation or warranty that this Website or any content, feature or transaction of the Website will be free from defects, errors or inaccuracies.  We make no guarantee that the site is free from viruses or other destructive transmissions.  This Website and its content are delivered on an AS-IS AND AS-AVAILABLE BASIS.  TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND FUNCTIONALITY. YOUR SOLE REMEDY IN THE EVENT OF DISSATISFACTION WITH THIS SITE IS TO STOP USING THIS SITE.  TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, FOR ANY MERCHADISE OFFERED FOR SALE OR ON THE APPRAISAL OF ANY ITEM SUBMITTED BY YOU RELATED TO LOANS OR PURCHASES BY US.  THE GOODS MADE AVAILABLE BY US FOR SALE ARE SECONDHAND GOODS.  WHILE WE ENDEAVOR TO REMOVE ALL CONTENT AND IMAGES FROM ELECTRONIC MEDIA, WE MAKE NO REPRESENTATION AND WARRANTY THAT SUCH ITEMS ARE WIPED “CLEAN” AND WE EXPRESSLY DISCLAIM ALL LIABILITY ASSOCIATED WITH CONTENT ON ALL ELECTRONIC DEVICES.

 

Limitation of Liability

You represent and warrant that such information is accurate.  To the extent that we determine it is not accurate, we have the right to discontinue your use of this Website.  Your passwords and registration information are for individual use only and you are responsible for maintaining the security of your password.  You are prohibited from any attempt to violate the security of this Website.  We reserve the right to investigate any attempt or perceived attempt to violate the security of this Website including providing registration information to law enforcement authorities in pursuit of such investigation of violation.

 

Privacy

The EZ Online Sales, Inc. Privacy Policy, which is found here and may be modified from time to time, applies to use of this Website and is incorporated into these Terms and Conditions by reference.

 

Miscellaneous

The laws of the State of Texas apply to these Terms and Conditions and your agreement to them.  Any controversy arising out of your use of this Website shall be brought solely in state or federal courts located in Travis County, Texas and you consent to jurisdiction of those courts.  If any part of these Terms and Conditions are deemed unlawful or unenforceable, that part will be deemed severable and will not impact the enforceability of the remaining Terms and Conditions.  No waiver of breach by us of these Terms and Conditions shall be deemed to be a waiver of a preceding or subsequent breach.
